Introduction

These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "User") and Skwadlink LLC ("Skwadlink," "we," "our," or "us"), the owner and operator of WhisperCoach, accessible at whispercoach.io (the "Service").

By accessing or using the Service, creating an account, or making a purchase, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them.

If you do not agree to these Terms, you must immediately discontinue use of the Service.

1. The Service

1.1 Description. WhisperCoach is an AI-powered interview coaching and communication support platform designed to help users organize their thoughts, recall relevant experience, and communicate clearly during job interviews and professional conversations. The Service uses artificial intelligence to surface structured talking points, response prompts, and communication guidance based on documents and context you provide. WhisperCoach is intended solely as a preparation and guidance tool. Users remain fully responsible for their own responses, decisions, and communications at all times.

1.2 Account Registration. To access the Service you must create an account by providing your full name and a valid email address. You agree to:

  • Provide accurate and complete information
  • Keep your account credentials confidential
  • Notify us immediately of any unauthorized access to your account at info@skwadlink.com
  • Accept responsibility for all activity that occurs under your account

1.3 Eligibility. The Service is intended for users who are 18 years of age or older. By using the Service you represent and warrant that you meet this requirement. WhisperCoach is not directed at or intended for use by minors.

2. Plans and Payments

2.1 Available Plans. WhisperCoach offers the following one-time purchase plans:

  • Single Session ($12.00 USD): grants access to one live coaching session
  • Sprint Mode — 72 Hours ($25.00 USD): grants unlimited session access for 72 consecutive hours from the time of purchase
  • Monthly Access ($34.00 USD): grants unlimited session access for 30 consecutive days from the time of purchase

2.2 Payment Processing. All payments are processed securely by Stripe, Inc. Skwadlink LLC does not store your payment card details. By completing a purchase you agree to Stripe's terms of service available at stripe.com/legal.

2.3 One-Time Purchases. All plans are one-time purchases and do not automatically renew. You will not be charged again unless you make a new purchase.

2.4 No Refunds. All sales are final. We do not offer refunds for any plan once purchased. If you experience a technical issue that prevents you from using the Service, please contact us at info@skwadlink.com and we will work to resolve the issue promptly.

2.5 Plan Expiration.

  • Single Session plans expire after one completed session
  • Sprint Mode plans expire 72 hours after the time of purchase regardless of usage
  • Monthly plans expire 30 days after the time of purchase regardless of usage
  • Expired plans cannot be extended or transferred

2.6 Pricing Changes. We reserve the right to change our pricing at any time. Price changes will not affect plans already purchased.

3. Permitted Use

You may use WhisperCoach solely for lawful, personal, non-commercial purposes including:

  • Preparing for job interviews
  • Preparing for investor or business pitch meetings
  • Practicing responses to anticipated questions
  • Reviewing past session history and performance analysis for personal improvement
  • Ensuring your use of WhisperCoach complies with any rules, policies, codes of conduct, or agreements imposed by your prospective employer, interviewer, recruiting platform, or any other third party involved in your interview or pitch process. Skwadlink LLC is not responsible for any consequences arising from your use of the Service in violation of such policies.

3A. Audio Processing and Recording Consent

WhisperCoach processes live audio during your coaching sessions in order to detect questions and generate AI-powered responses. By starting a session you explicitly consent to this audio processing.

You acknowledge that audio recording and interception laws vary by jurisdiction. Many US states including California, Florida, Illinois, Pennsylvania, and Washington require the consent of all parties to a conversation before it may be recorded or intercepted. You are solely responsible for ensuring that your use of WhisperCoach complies with all applicable recording and wiretapping laws in your jurisdiction and the jurisdiction of any other party on your call.

Skwadlink LLC processes audio solely to provide the Service and does not store raw audio recordings of your sessions.

3B. User Responsibility and Compliance

Users are solely responsible for ensuring that their use of WhisperCoach complies with all applicable laws, employer policies, recruiting platform rules, interview guidelines, and professional obligations. WhisperCoach is designed as a communication coaching and guidance tool and does not guarantee compliance with any third-party policies or requirements. Skwadlink LLC shall not be liable for any consequences arising from a user's failure to comply with applicable rules or policies governing their interview, assessment, or professional engagement.

3C. No Impersonation or Identity Misrepresentation

Users may not use WhisperCoach in connection with impersonation, deepfake technologies, falsified identities, voice synthesis intended to mimic another person, or any deceptive conduct intended to misrepresent the identity of the user during interviews, meetings, assessments, or any other professional engagement. Violation of this provision may result in immediate account termination and may expose the user to civil or criminal liability.

3D. No Guarantee of Undetectability

WhisperCoach does not guarantee that use of the Service will be undetectable by third parties including employers, interviewers, recruiting platforms, proctoring systems, or assessment tools. Users assume full responsibility for any consequences arising from the detection or discovery of their use of the Service during any interview, assessment, or professional engagement.

4. Prohibited Use

You agree that you will not use WhisperCoach to:

4.1 Academic and Professional Misconduct.

  • Use the Service in violation of applicable academic integrity rules, professional conduct policies, hiring platform requirements, recruiting guidelines, or applicable laws
  • Violate any academic integrity policy or professional code of conduct

4.2 Unauthorized Commercial Use.

  • Resell, sublicense, or otherwise commercialize access to the Service without our express written permission
  • Use the Service to build a competing product or service
  • Scrape, copy, or reproduce any part of the Service or its outputs for commercial purposes

4.3 Abusive or Harmful Use.

  • Use automated bots, scripts, or tools to access or abuse the Service
  • Attempt to reverse engineer, decompile, or extract source code from the Service
  • Circumvent any security measures or access controls
  • Transmit malware, viruses, or malicious code
  • Harass, threaten, or harm any person through use of the Service
  • Upload content that is illegal, defamatory, obscene, or infringes on any third-party rights

4.4 Misrepresentation.

  • Impersonate any person or entity
  • Falsely claim affiliation with any person, company, or organization
  • Use WhisperCoach in any way intended to deceive a hiring manager, investor, or other party in a manner that constitutes fraud under applicable law

4.5 Illegal Activity.

  • Use the Service for any purpose that violates applicable local, state, national, or international law or regulation

5. Artificial Intelligence Disclaimer

5.1 Nature of AI Outputs. WhisperCoach uses Anthropic's Claude AI to generate suggested responses. You acknowledge and agree that:

  • AI-generated responses are suggestions only and do not constitute professional advice of any kind including legal, financial, medical, or career advice
  • AI outputs may be inaccurate, incomplete, or inappropriate for your specific situation
  • You are solely responsible for evaluating, editing, and deciding whether to use any AI-generated content
  • Skwadlink LLC makes no warranty that AI-generated responses will be accurate, appropriate, or fit for any particular purpose

5.2 No Guarantee of Outcomes. WhisperCoach does not guarantee any specific outcome from use of the Service including but not limited to securing employment, obtaining investment, or achieving any professional or business goal. Results depend entirely on factors outside our control.

6. Intellectual Property

6.1 Our Property. The Service and all of its contents including but not limited to software, design, text, graphics, logos, and the WhisperCoach name and brand are owned by Skwadlink LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

6.2 Your Content. You retain ownership of all documents, content, and information you upload or provide to the Service including resumes, job descriptions, and pitch materials. By uploading content you grant Skwadlink LLC a limited, non-exclusive license to process your content solely for the purpose of providing the Service to you.

6.3 Feedback. If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.

7. Privacy

Your use of the Service is also governed by our Privacy Policy available at whispercoach.io/privacy, which is incorporated into these Terms by reference. By using the Service you consent to the data practices described in our Privacy Policy.

8. Third-Party Services

The Service integrates with third-party services including Anthropic, Stripe, and Supabase. Your use of these services is subject to their respective terms and privacy policies. Skwadlink LLC is not responsible for the practices or content of any third-party services.

8.1 AI Service Availability. WhisperCoach relies on Anthropic's Claude AI to provide coaching guidance. The availability, accuracy, and quality of AI-generated content may be affected by third-party service outages, model updates, rate limits, or other factors outside our control. Skwadlink LLC does not guarantee uninterrupted AI service availability and shall not be liable for any degradation in service quality resulting from third-party AI provider issues.

8.2 Audio Processing. WhisperCoach processes live audio temporarily during your session solely to provide real-time coaching functionality. Raw audio is not permanently stored by Skwadlink LLC. Session metadata including coaching prompts, talking points surfaced, and session summaries may be retained in your session history as described in our Privacy Policy.

9. Disclaimers and Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF CONTENT
  • UNINTERRUPTED OR ERROR-FREE OPERATION

SKWADLINK LLC DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY ERRORS WILL BE CORRECTED.

YOUR USE OF WHISPERCOACH IS ENTIRELY AT YOUR OWN RISK. YOU ASSUME FULL RESPONSIBILITY FOR ANY CONSEQUENCES ARISING FROM YOUR USE OF THE SERVICE OR ANY AI-GENERATED CONTENT PROVIDED THROUGH IT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SKWADLINK LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
  • DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE
  • DAMAGES ARISING FROM AI-GENERATED CONTENT
  • DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT

IN NO EVENT SHALL SKWADLINK LLC'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO SKWADLINK LLC IN THE 12 MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless Skwadlink LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses including reasonable legal fees arising out of or in connection with:

  • Your use of or access to the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you upload or provide to the Service

12. Termination

12.1 Termination by You. You may terminate your account at any time by deleting your account within the Service or by contacting us at info@skwadlink.com. Termination does not entitle you to a refund of any unused portion of a purchased plan.

12.2 Termination by Us. We reserve the right to suspend or terminate your account and access to the Service at any time and without notice if we determine in our sole discretion that you have violated these Terms or engaged in conduct harmful to other users or to Skwadlink LLC.

12.3 Effect of Termination. Upon termination all licenses granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination will survive including but not limited to Sections 6, 9, 10, 11, and 13.

13. Governing Law and Disputes

13.1 Governing Law. These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.

13.2 Dispute Resolution and Arbitration. Before filing any formal legal claim, you agree to first contact us at info@skwadlink.com and attempt to resolve the dispute informally. We will attempt to resolve any dispute within 30 days of receiving written notice. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction where necessary to prevent irreparable harm. You and Skwadlink LLC agree to waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration. Arbitration shall take place in the State of Florida unless otherwise required by applicable law. Each party shall bear its own costs and attorneys' fees unless the arbitrator determines otherwise under applicable law.

13.3 Jurisdiction. If informal resolution fails, any legal action arising out of or related to these Terms or the Service shall be brought exclusively in the state or federal courts located in the State of Florida. You consent to the personal jurisdiction of such courts.

13.4 Class Action Waiver. As stated in Section 13.2, you waive your right to participate in a class action lawsuit or class-wide arbitration against Skwadlink LLC to the fullest extent permitted by law.

14. General Provisions

14.1 Entire Agreement. These Terms together with our Privacy Policy constitute the entire agreement between you and Skwadlink LLC regarding the Service and supersede all prior agreements.

14.2 Severability. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.

14.3 Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.

14.4 Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.

14.5 Force Majeure. Skwadlink LLC shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government action, power failure, internet outages, or failure of third-party service providers. In such events our obligations will be suspended for the duration of the circumstance.

14.6 Changes to Terms. We reserve the right to update these Terms at any time. We will notify you of material changes by email or prominent notice on our website at least 14 days before changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
